Contractual disputes

Where the company is a party to the contract, and action is instituted either by or against the company, where the quantum of the claim exceeds R15 000.00.


Delictual damage claims

We Institute or defend Delictual damages claims in the event of an accident involving a motor vehicle registered in the name of the company or sole owner, and where the driver at the time was acting in the course and scope of his/her employment with the company.


Contractor disputes

Disputes with contractors for poor workmanship in respect of repairs / alterations to the business premises, including branch or satellite offices.


Tenant eviction

Eviction of tenants from both commercial and residential premises, where the company is in the business of leasing property to 3rd parties, limited to a maximum of 5 such evictions per annum.


Appeal or Review

One Appeal or Review where we had assisted with the main case which is the subject of the appeal or review, but subject to the overall cover limit of the main case (i.e. an Appeal or Review is seen as a continuation of the main case, and not as a separate case with its own cover limit) and provided that in the sole discretion of us or our appointed Service Provider, there are prospects of success (merits) in the appeal or review.


Please note that matters that happened prior to the start date of the plan are not covered.

Labour


What's covered:

  • Any matter instituted by or against the company in terms of the Labour laws of South Africa, in the CCMA, Bargaining Councils or Labour Court, including actions for unfair dismissals, unfair retrenchments, unfair labour practices, unfair discrimination, and enforcements of restraint of trade agreements;
  • Advice in respect of the correct procedure to follow for grievance procedures, disciplinary actions, dismissals, retrenchments, dealing with strikes and lock-outs and wage disputes;
  • One Appeal or Review where we had assisted with the main case which is the subject of the appeal or review, but subject to the overall cover limit of the main case (ie an Appeal or Review is seen as a continuation of the main case, and not as a separate case with its own cover limit. This is applicable to Labour Court matters, and in so far as allowed by law, in respect of decisions by the CCMA and/or a Bargaining Council) and provided that in the sole discretion of us or our appointed Service Provider, there are prospects of success (merits) in the appeal or review.

Criminal


What's covered:

  • Where a criminal matter is instituted against the director(s) and/or officer(s) and/or sole owners of the company, for an alleged offence relating to the main business of the company or in contravention of the Companies Act or any other applicable legislation. Criminal charges against the policyholder(s) in respect of offences relating to the Environmental Affairs Act will be specifically excluded from cover.
  • Bail Applications during regular court hours, but excluding the payment of the bail amount determined by bail application court (excludes employees).
  • One Appeal or Review where we had assisted with the main case which is the subject of the appeal or review, but subject to the overall cover limit of the main case (ie an Appeal or Review is seen as a continuation of the main case, and not as a separate case with its own cover limit) and provided that in the sole discretion of us or our appointed Service Provider, there are prospects of success (merits) in the appeal or review.

Please note that matters that happened prior to the start date of the plan are not covered.

Debt collection


What's covered:

  • Assistance with the collection of the company's debts, where the debt exceeds R15 000, and where the company has exhausted all internal processes to try and recover this debt.
  • This benefit will specifically not apply to registered Debt Collection Agencies or companies whose primary business is to collect debts on behalf of 3rd parties.
  • It will also not apply to a company who had purchased a book of bad debt from a 3rd party with the view of collecting those debts by using the debt collection benefit under this policy.

  1. Company should be registered and operating in South Africa
  2. Valid South African Bank account from which premiums will be paid
  3. Company should have less than R60 million turnover
